Update regarding $100,000 fee to H-1B visas
The fee does not apply to current visa holders or applicants
Government agencies have clarified that the announced $100,000 fee for H-1B visa program participants does not apply to current visa holders or those whose applications have been submitted or approved. Both CBP and USCIS have issued guidance to that effect. USCIS guidance states:
"This proclamation only applies prospectively to petitions that have not yet been filed. The proclamation does not apply to aliens who: are the beneficiaries of petitions that were filed prior to the effective date of the proclamation, are the beneficiaries of currently approved petitions, or are in possession of validly issued H-1B non-immigrant visas.”
